This privacy notice sets out how That Prize Guy complies with UK GDPR requirements. This applies to the entire website and social media platforms and any postal entries to our competitions. Any changes to these policies will be posted on this website.

What information do you collect about me?

The website is structured so that, in general, you can visit without identifying yourself or revealing any personal information. Once you choose to provide us with any information by which you can be identified, then you can be assured that it will be held securely and used in accordance with this privacy notice. If we need to use your personal data for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so.

When using our services we may collect the following types of information, some of which is considered personal data:

• Your name, email address, contact number, financial information to pay a prize, this will include your sort code and account number and is different to the financial details you provide to enter our competitions.

• If you enter via our free entry route, or win free entry to a competition, we may process your name, contact details, date of birth and contact number.

• If you win a prize, we will also require a copy of a government issued photo identification, for example, drivers’ licence, passport etc.

• If you win a prize, with your consent, we may process your image, voice (and any other information that identifies you) in any footage that will be published by us online. 

• Some pages use cookies, a data analysis technique.

• Demographic information such as post code, preferences and interests;

• IP address (automatically collected);

• Web browser type and version (automatically collected);

• Operating system (automatically collected); 

• We may also ask you to provide us with information regarding your personal or professional interests, demographics, experiences with our services and contact preferences in order to provide you with further correspondence about our services.

For users that register on our website we also store the personal information you provide in your user profile (includes your username and password). All users can see, edit, or delete your personal information at any time (except you cannot change your login email address). Website administrators can also see and edit that information.

Cookies

• If you visit our login page, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.
• When you create an account with That Prize Guy to enter competitions, you may opt to save your name, password and email address. We will set up several cookies to save your login information and your screen display choices.

About cookies & What They Mean

Live Draws

We may use a live stream on our social media platforms to choose the winner of our competitions. To do this we use a google number generator to select a random number to pick the winner. For those that entered the competition, their usernames will appear within this live stream. If you wish to not ensure that none of your personal data appears in the live stream you should choose a username that has no information that may identify you. You can change your username at any time.

Should you wish to follow our live draws on our social media platforms, you should be aware that other individuals who have also joined the live draw will see your social media display name and will be able to read any comments you may make. That Prize Guy does not store any data from these interactions. For more information you should refer to the Privacy Policy relating to the relevant social media platform.

How and why do you use my personal data?

When you create an account with That Prize Guy we use your name and contact information to register you.  If you enter via the free entry route, or win free entry to a competition, we may process the following personal data; your name, Date of Birth, and contact details. To enable you to participate in any pay to enter competitions you will be required to input card payment information. You can choose to save your financial data for your convenience - we use Cashflows to process and store this financial information. Alternatively, you can use Apple Pay, Google Pay or PayPal. Should you win a monetary prize, we process financial information to pay that prize. We will require your sort code and account number. This information is necessary for the performance of a contract with you, to enter, take part and pay any prizes due as part of that prize draw or competition.  This information will be held until you request to have your data erased.  Where we need to collect personal data by law, or under the terms of a contract we have with you, and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with goods or services or to enter you into a competition). In this case, we may have to cancel a product or service you have with us. We will notify you if this is the case at the time. That Prize Guy may also communicate with you in response to any query, request or complaint you may have.  That Prize Guy may also contact you to update you in relation to changes to our Terms and Conditions or our Privacy Policy.  That Prize Guy may also contact you, if you wish to opt in, for market research purposes, to allow the consideration of new prize ideas and to assess and improve our service and business or about new services or other information which we think you may find interesting. This information is necessary for the performance of a contract with you, necessary to comply with a legal obligation and for our legitimate interests to assess and improve our service.

Should you win a prize you will be invited to participate in publicity exercises relating to the competition. This can include your image or voice in pictures and/or videos and will be shared on our social media and/or our website.  Your participation is not compulsory but would be greatly appreciated by us. If you do not wish to participate your participation in the competition or chances of winning will not be affected in any way.  Our lawful basis for this is consent.

That Prize Guy may also use your personal and financial information of transactions between That Prize Guy and you to enable us to comply with our administrative, legal and regulatory obligations. This is necessary to comply with a legal obligation.

Some information is used to identify fraud or fraudulent activity and also to ensure that transactions with you are not fraudulent.  Should you win a prize, we will require a copy of photo identification to prove you are over the age of 18. We keep this on file, for your convenience, should you win future prizes. However, you can request that your photo identification is erased at any time. This is necessary to comply with a legal obligation and our own legitimate interests to ensure transactions with you are not fraudulent.

How long do you hold my personal data?

We will only keep your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting or reporting requirements. 

To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements. 

What legal rights do I have?

Please note your GDPR rights will depend on the lawful basis we rely on to process your data.

If we hold your personal data, you have the right to:

Request access to your personal data. -You can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we could refuse to comply with your request in these circumstances.

Request any inaccurate personal data held is rectified - This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.

Request erasure of your personal data - You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes and we will notify you of this at the time of your request.

Withdraw consent – You can withdraw your consent at any time where we are relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent.

Object to processing of your personal data – where we are relying on a legitimate interest to process. You can object to processing where you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your personal data for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.
